1. Who We Are
Kensley Company LLC is a commercial equipment finance brokerage headquartered in Miami, Florida. We assist business entities with obtaining financing for equipment purchases through a network of independent equipment finance lenders. We do not extend credit directly. All financing decisions are made by the underlying lender.
Our services are available exclusively to business entities. We do not offer consumer financing.

4. Mobile Information and SMS Communications
This section governs all SMS / text message communications with Kensley Company LLC.
How We Collect Mobile Information
Kensley Company LLC collects mobile phone numbers when you provide them through our website forms, by phone, or in other communications with us. Mobile information is collected only when you affirmatively provide it.
How We Use Mobile Information
We use the mobile phone numbers you provide to:

- Confirm appointments and provide application status updates

Mobile Information Sharing
Kensley Company LLC does not sell, rent, lease, or share mobile information with any third party for marketing or promotional purposes. No mobile information collected through our SMS program will be shared with affiliates or third parties for their marketing purposes. Mobile information may be shared only with service providers who help us deliver SMS messages (such as our SMS messaging platform vendor), and only to the extent necessary to deliver our messages to you. These service providers are contractually prohibited from using your information for any other purpose.
Your Choices
You may opt out of SMS messages at any time by:
- Replying STOP, END, QUIT, UNSUBSCRIBE, or CANCEL to any message
- Submitting the opt-out form at kensleycompany.com/opt-out
- Emailing info@kensleycompany.com with “UNSUBSCRIBE” in the subject line
After you opt out, you will receive one final confirmation message and no further marketing or promotional messages. Transactional messages required to complete an active financing application may still be sent unless you formally withdraw your application.
Charges
Message and data rates may apply. Charges are billed by and payable to your mobile service provider. Kensley does not charge for SMS messages.
Data Retention for SMS
We retain mobile information and SMS opt-in records — including timestamp, IP address, user agent, and the consent language displayed at the time of opt-in — for a minimum of five years after your last interaction with us, in order to demonstrate compliance with the Telephone Consumer Protection Act and applicable state laws.

5. How We Share Information
We share information only as described below.
Equipment Finance Lenders
To broker your financing, we submit your application and supporting information to one or more equipment finance lenders in our network. These lenders independently evaluate your application and make their own credit decisions. Each lender has its own privacy practices, which we encourage you to review.
Service Providers
We share information with third-party vendors who help us operate our business, including:
- Website hosting providers
- SMS messaging platform providers (e.g., Twilio)
- Email service providers
- CRM and database providers
- Analytics providers (e.g., Google Analytics)
- Payment processors
- Professional advisors (attorneys, accountants)
Service providers are contractually prohibited from using your information for purposes other than providing services to Kensley.
Legal Requirements
We may share information when we believe in good faith that disclosure is necessary to:
- Comply with applicable law, regulation, subpoena, or legal process
- Respond to lawful requests from public authorities
- Protect our rights, property, or safety, or that of our clients or the public
- Enforce our Terms of Service or other agreements

We do not sell your personal information. We do not rent or lease your personal information. We do not share your mobile information with affiliates or third parties for their marketing purposes.

We retain personal information for as long as necessary to:

Specific retention periods:
- Active application data: Retained for the duration of the application plus 7 years
- SMS opt-in records: Minimum 5 years from last interaction
- Website analytics data: Up to 26 months (Google Analytics default)
- Marketing opt-in records: Until you opt out, then archived for 3 years
- Business records: As required by applicable tax, accounting, and corporate law
After retention periods expire, we delete or anonymize information unless required to retain it longer by law.
7. Data Security
We implement reasonable administrative, technical, and physical safeguards designed to protect personal information from unauthorized access, disclosure, alteration, and destruction. These safeguards include:
- Encrypted data transmission (SSL/TLS)
- Access controls and authentication on internal systems

Opt-out from marketing does not affect transactional communications related to your active application.

Our services are intended for business representatives over the age of 18. We do not knowingly collect personal information from minors. If we learn we have collected information from a child under 18, we will delete it promptly.
